Terms and Conditions

These Terms and Conditions govern your access to bleure.com, any buyer dashboard, BLEU DocBox™, account or document portal available through it, and the information and tools offered on the site (collectively, the “Site”). The Site is operated by BLEU Realty GA LLC d/b/a BLEU Real Estate and, when identified in a particular service or transaction, Bleu Real Estate Plus LLC d/b/a BLEU Real Estate Plus (collectively, “BLEU,” “we,” “us,” or “our”). By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

A signed brokerage engagement, purchase or sale agreement, program document, or other transaction-specific agreement may contain additional terms. If those terms conflict with these Terms, the transaction-specific agreement controls for that subject.

1. Website use does not create a brokerage relationship

Viewing the Site, requesting information, receiving property information, or communicating with BLEU does not by itself make you a client or create an agency, fiduciary, brokerage, lender, contractor, or other professional relationship. A client relationship with BLEU is created only through a written brokerage engagement signed by BLEU and the client. Until then, BLEU may treat you as a visitor or customer and may provide only the assistance permitted by law.

Information on the Site is general and is not legal, tax, accounting, insurance, engineering, inspection, construction, or lending advice. Consult the appropriate licensed professional about your circumstances.

2. Eligibility, accounts, and BLEU DocBox

You must be at least 18 years old and legally able to enter into these Terms. If you receive login credentials, you are responsible for keeping them confidential, using them only as authorized, and promptly telling us about suspected unauthorized access.

BLEU DocBox and other account features are provided for convenience. Do not use the Site as your only copy of an important record. Download and keep documents you are required to retain. Do not send Social Security numbers, complete bank or payment-card information, unredacted government identification, passwords, complete credit reports, tax returns, pay stubs, or lender underwriting files through the buyer dashboard, ordinary email, or an unsecured form. Use only a secure method specifically approved by BLEU or the appropriate provider for that information.

A buyer dashboard, Buying Plan, readiness indicator, progress bar, or access level is an administrative planning tool. It may be updated from information supplied by you, BLEU personnel, or an authorized workflow integration and may not update instantly. It is not a credit decision, lender approval, property recommendation, or guarantee that you can or should purchase. Exclusive Access may depend on current readiness steps and may be restricted, corrected, suspended, or removed when information is incomplete, inaccurate, expired, or no longer applicable.

3. Real estate and property information

Property information may come from multiple listing services, public records, owners, agents, builders, and other third parties. Information is believed reliable but is not guaranteed. Price, availability, square footage, boundaries, taxes, school information, measurements, condition, features, and listing status can change or contain errors. You should independently verify information that is important to your decision and obtain appropriate inspections, surveys, title review, and professional advice.

Curated matches, portal search results, photographs, and listing details are provided for personal, noncommercial real estate use. They may be supplied by an owner, listing brokerage, FMLS, Georgia MLS, another multiple-listing service, or an authorized data provider. Applicable source, listing-firm, and copyright notices are part of the display and may not be removed. A match is not an appraisal, inspection, guarantee, or representation that the property is suitable, available, financeable, or eligible for a BLEU program.

A request to tour a property is not confirmed until BLEU expressly confirms the appointment. Do not enter a property, contact an occupant or seller, or rely on a requested time before confirmation. Where required, you must sign an applicable written buyer agreement before BLEU tours a property with you.

BLEU supports equal housing opportunity and provides services without unlawful discrimination. Nothing on the Site is intended to express a preference, limitation, or discrimination based on a protected characteristic.

4. BLEU Closing Essentials

The BLEU Closing Essentials is a BLEU program that may identify a property for review for potential funds toward allowable closing expenses. “Potentially Eligible” is an initial screen, “Reviewed Estimate” is a preliminary estimate, and “Confirmed for Offer” means BLEU has approved an amount for inclusion in the proposed transaction terms. No label or estimate is cash, a promise of funds, or a guarantee that a transaction will close.

Final eligibility and amount depend on the property, purchase terms, applicable program rules, lender and closing-provider approval, actual allowable closing costs, and BLEU’s transaction review. A benefit may be reduced or unavailable if the transaction changes, allowable costs are insufficient, or applicable law, lender rules, or closing instructions do not permit it. Any approved credit will be stated in the applicable transaction and closing documents. The BLEU Closing Essentials is separate from the MLS and listing brokerage and is not an offer of brokerage compensation through an MLS.

5. Financing and preferred lenders

BLEU is a real estate brokerage. BLEU is not a lender, mortgage broker, loan servicer, credit-repair company, or credit counselor. Financing information is general. Loan availability, interest rates, fees, down-payment assistance, underwriting, property eligibility, and approval are determined by the lender and applicable program rules. No financing result is promised.

Selecting a preapproval or lender-introduction request on the Site asks BLEU to follow up and, when appropriate, share your contact details and general request with an independent lender. It is not a loan application, credit authorization, preapproval, or commitment to lend. Submit any sensitive financial or underwriting information directly to the lender through the lender’s approved secure process.

Programs that may be available through independent lenders include conventional, FHA, VA, USDA, investor, and down-payment-assistance options. Availability depends on the borrower, property, lender, market, and program requirements. A lender may require documents and make inquiries that BLEU does not control.

BLEU may identify lenders that have provided reliable service to clients. You are never required to use a lender identified by BLEU and are encouraged to compare providers, rates, fees, and terms. As of the date above, BLEU has no ownership or material financial relationship with lenders described as preferred partners and does not receive compensation merely because a consumer chooses one of those lenders. If an arrangement changes or a financial or other referral benefit applies, BLEU will provide any disclosure required by law.

BLEU’s veteran-focused support is intended to help clients understand the real estate steps that often accompany VA financing. BLEU is not affiliated with or endorsed by the U.S. Department of Veterans Affairs or Department of Defense, does not determine benefit or loan eligibility, and cannot issue a Certificate of Eligibility. Eligibility and documentation, which may include a Certificate of Eligibility or service records, are determined by the VA and the lender.

6. Other service-provider referrals

At your request, BLEU may provide contact information for independent lenders, closing attorneys, title providers, inspectors, insurers, contractors, and other service providers. They are not BLEU employees or agents unless we clearly state otherwise in writing. You are free to choose another provider, shop for services, and make your own decision. BLEU does not guarantee a provider’s availability, pricing, licensing, insurance, advice, work, or results.

If BLEU or a licensee will receive a fee, rebate, gift, marketing benefit, or other thing of value connected to a referral, any disclosure required by RESPA, Georgia real estate rules, or another law will be made separately and at the required time. This general Site notice does not replace a transaction-specific disclosure.

7. BLEU Year One™

A statement that a closing is “covered” by BLEU Year One means access to the program described in the written terms provided for that closing. It does not mean that a home, repair, improvement, or expense is insured or paid.

BLEU Year One is a client-support and contractor-access benefit. It is not a home warranty, insurance policy, service contract, emergency service, maintenance plan, or promise by BLEU to repair, replace, reimburse, or pay for any item. The program may help an enrolled client locate independent contractors and may make preferred or discounted pricing available during the program period. Availability, service area, response time, contractor participation, pricing, discount, scope, and results are not guaranteed. A preferred price may not be the lowest available price.

Unless written program terms expressly say otherwise, the client selects and contracts directly with the contractor and is responsible for estimates, permits, approvals, payment, and verification of licensing and insurance. Contractors are independent businesses, not BLEU employees or agents. BLEU is not responsible for their acts, omissions, advice, materials, warranties, delays, injuries, property damage, or workmanship.

Projects such as basement finishing, fences, repairs, or improvements may require permits, inspections, utility approval, association approval, lender approval, or insurance review. The client is responsible for confirming those requirements. For an emergency or suspected danger, contact 911, the appropriate utility, insurer, or a qualified emergency provider; do not rely on BLEU Year One.

The written BLEU Year One terms issued for a client’s closing control eligibility, start and end dates, exclusions, request procedures, and any transaction-specific benefit.

8. Calls, texts, and email

When you contact BLEU, you authorize us to respond to your request using the contact information and reasonable communication methods you provide. This does not create consent for automated or marketing calls or texts when separate consent is required by law.

If you separately opt in to marketing calls or texts, consent is not a condition of buying property, selling property, or receiving brokerage services. Message and data rates may apply. You may reply STOP to an eligible text message to opt out and HELP for help. You may unsubscribe from marketing emails using the link in the message. We may still send non-marketing communications about an account, security issue, request, or active transaction when permitted by law.

9. Third-party tools, links, and embedded content

The Site may use or link to services operated by third parties, including maps, video players, analytics, social media, transaction tools, and service-provider websites. Third parties control their own services, availability, terms, and privacy practices. A link or integration does not create an endorsement or make BLEU responsible for the third party.

10. Intellectual property

The Site and its content, design, text, graphics, logos, and other materials are owned by or licensed to BLEU and are protected by law. BLEU, BLEU Real Estate, BLEU Year One™, associated logos, and related branding may not be used without written permission. You may view and print a reasonable number of pages for personal, noncommercial real estate purposes. No other right or license is granted.

11. Acceptable use

You may not:

  • use the Site for an unlawful, fraudulent, discriminatory, or harmful purpose;
  • impersonate another person or misstate your affiliation;
  • upload material you do not have the right to provide;
  • attempt to gain unauthorized access to an account, system, or data;
  • introduce malware or interfere with the Site’s operation;
  • scrape, harvest, copy, resell, or redistribute listing data or Site content except as expressly permitted; or
  • remove intellectual-property, attribution, or legal notices.

We may restrict or terminate access when reasonably necessary to protect users, BLEU, service providers, or the Site, or to comply with law.

12. Information you provide

You represent that information and documents you provide are accurate to the best of your knowledge and that you have the right to provide them. Do not upload another person’s confidential or personal information without authorization. Transaction documents and personal information are handled as described in our Privacy Policy and applicable brokerage obligations. If you provide general suggestions or feedback about the Site, you allow BLEU to use them without payment or attribution, but this does not give BLEU ownership of your transaction documents.

13. Accessibility

BLEU seeks to provide access to its services for people with disabilities. If you have difficulty using the Site or need information in another format, contact us at home@bleure.com or 678-253-8739. We will work with you to provide reasonable access to the information or service.

14. Site availability and changes

We may update, suspend, or discontinue a Site feature for maintenance, security, legal, or business reasons. We do not promise that the Site will always be available, error-free, or free of harmful code. We may correct errors and update content without notice.

15. Disclaimers

To the fullest extent permitted by law, the Site is provided “as is” and “as available.” BLEU disclaims warranties relating to the Site, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. BLEU does not guarantee a purchase, sale, closing, financing approval, property result, contractor result, or uninterrupted access.

These disclaimers do not limit duties that cannot legally be waived, duties in a signed brokerage engagement, or liability for fraud, willful misconduct, or gross negligence.

16. Limitation of liability

To the fullest extent permitted by law, BLEU and its owners, officers, employees, and affiliated licensees will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Site or your reliance on Site content. For a claim arising only from use of the Site, BLEU’s total liability will not exceed the greater of the amount you paid BLEU specifically for use of the Site during the 12 months before the claim or $100.

This section does not limit nonwaivable rights or obligations arising under applicable law or a signed transaction-specific agreement.

17. Indemnification

To the extent permitted by law, you agree to defend and indemnify BLEU from third-party claims, losses, or expenses caused by your unlawful use of the Site, your material violation of these Terms, or content you provide without the required rights or authorization. This does not require you to indemnify BLEU for BLEU’s own unlawful conduct.

18. Governing law and disputes

Georgia law governs these Terms, without regard to conflict-of-law rules, except where federal or another state’s law must apply. Before filing a Site-related claim, you and BLEU agree to make a good-faith effort to resolve it by written notice and at least 30 days of informal discussion. If it is not resolved, a court with proper jurisdiction may hear the dispute. Any arbitration, jury waiver, or dispute term in a separately signed agreement controls disputes covered by that agreement.

19. Other terms

If part of these Terms is unenforceable, the rest remains in effect. A failure to enforce a term is not a waiver. You may not assign your Site rights without our consent; BLEU may assign these Terms in connection with a lawful merger, sale, or reorganization. Headings are for convenience only.

20. Changes to these Terms

We may update these Terms to reflect changes in the Site, services, or law. The “Last updated” date shows the latest revision. Material changes apply prospectively unless the law permits otherwise. Your continued use after revised Terms are posted means you accept the revised Terms.
